1. Introductory Provisions

1.1 These General Terms and Conditions (hereinafter referred to as the “GTC”) govern the rights and obligations between DAMIFIT s.r.o. (hereinafter referred to as the “Operator”) and the clients of the fitness center (hereinafter referred to as the “Client”).

1.2 The GTC apply to all services provided by the Operator, in particular the use of the fitness center, personal training, group exercises, consulting, and other supplementary services.

1.3 By using the services of the fitness center, the Client confirms that they have read these GTC and agree to them.

2. Operation of the Fitness Center

2.1 The fitness center is accessible to clients during the opening hours posted on the premises or on the operator’s website.

2.2 The operator reserves the right to change the opening hours or temporarily close the facility for technical, hygienic, or organizational reasons.

2.3 Clients are required to follow the instructions of the staff and comply with the fitness center’s rules and regulations.

3. Terms of Service Use

3.1 The fitness center’s services may be used by individuals over the age of 15. Individuals under the age of 18 may use the services only with the consent of a legal guardian.

3.2 The client uses the fitness center’s services at their own risk and confirms that their health condition allows them to engage in physical activity.

3.3 The operator is not liable for health complications arising from the improper use of equipment or the client’s failure to acknowledge their health limitations.

3.4 The client is required to wear appropriate athletic clothing and clean athletic shoes.

4. Memberships and Single-Visit Passes

4.1 The fitness center’s services may be used on a single-visit basis or by purchasing a membership.

4.2 A membership is non-transferable unless the operator specifies otherwise.

4.3 The validity of a membership is time-limited depending on the specific type of membership.

4.4 Upon expiration of the membership, the client is not entitled to a refund for unused visits.

4.5 The operator reserves the right to change service prices.

5. Service Reservations

5.1 Reservations may be required for certain services (e.g., personal training or group exercise classes).

5.2 Reservations may be canceled no later than 24 hours before the start of the service, unless the operator specifies otherwise.

5.3 In the event of a late cancellation or no-show, the service may be considered used.

6. Safety and Liability

6.1 The client is required to use the fitness center’s equipment with care and in accordance with its intended purpose.

6.2 The client is fully liable for any damage caused by the client’s intentional or negligent actions.

6.3 The Operator is not liable for the loss or damage of the Client’s personal belongings left on the premises of the fitness center.

7. Protection of Personal Data

7.1 The Operator processes Clients’ personal data in accordance with applicable data protection legislation.

7.2 Personal data is processed for the purposes of client registration, service provision, and communication with customers.

7.3 Details regarding the processing of personal data are set forth in a separate document titled “Privacy Policy.”

8. Final Provisions

8.1 The Operator reserves the right to amend or supplement these Terms and Conditions at any time.

8.2 The updated version of the GTC will be posted at the fitness center or on the Operator’s website.

8.3 These GTC shall enter into force and become effective on the date of their publication.
